Terms and Conditions
1. General
1.1 These General Terms and Conditions (hereinafter: "Terms") apply to all agreements, offers, orders and deliveries of HypeAndTrend.com, located at Stephanusstraat 21, 6363BM Wijnandsrade, the Netherlands , hereinafter referred to as "HypeAndTrend.com", to the customer (hereinafter: "Customer").
1.2 By placing an order or using the services of HypeAndTrend.com, the Customer agrees to these Terms and Conditions.
1.3 HypeAndTrend.com reserves the right to change these Terms at any time. The changed Terms will come into effect as soon as they are posted on the HypeAndTrend.com website, unless otherwise stated.
2. Offers and Agreements
2.1 All offers and prices on the HypeAndTrend.com website are without obligation and may be changed without prior notice.
2.2 An agreement between HypeAndTrend.com and the Customer is concluded when the Customer places an order via the HypeAndTrend.com website and the order has been confirmed by HypeAndTrend.com.
2.3 HypeAndTrend.com reserves the right to refuse or cancel an order, for example in the event of incorrect product information or unsuccessful payments.
3. Orders and Payment
3.1 The Customer is obliged to provide correct and complete information when placing an order, including name, address, email address and payment details.
3.2 Payments for orders can be made via the available payment methods, such as iDEAL, Visa, Mastercard and PayPal.
3.3 All prices on the HypeAndTrend.com website are in euros and include VAT, unless otherwise stated. Any additional costs, such as shipping costs, will be clearly displayed to the Customer during the ordering process.
4. Delivery
4.1 The delivery of the ordered products will take place at the address specified by the Customer.
4.2 The delivery time is indicated with the order and is usually 3-5 working days , unless otherwise stated. HypeAndTrend.com is not liable for delays that are beyond its sphere of influence.
4.3 The Customer is obliged to check the delivered product upon receipt. If the product is damaged or does not correspond with the order, the Customer must report this within 48 hours of receipt.
5. Right of withdrawal and returns
5.1 The Customer has the right to cancel the agreement within 30 days after receipt of the order without giving any reason, in accordance with the statutory right of withdrawal.
5.2 In case of withdrawal, the Customer must return the product in the undamaged, unopened and original packaging. The costs for returning are for the Customer.
5.3 The purchase amount will be refunded within 14 days after receipt of the return shipment, provided that the return conditions have been met.
5.4 The right of withdrawal does not apply to the following products, due to hygiene:
- Intimate garments such as underwear and swimwear
- Personalized or custom made products
- Products whose seal has been broken after delivery
6. Liability
6.1 HypeAndTrend.com is not liable for any damage resulting from the use of the products, unless there is intent or gross negligence.
6.2 HypeAndTrend.com is not liable for indirect damage, consequential damage or damage resulting from force majeure.
6.3 HypeAndTrend.com is also not liable for damage resulting from failure to comply with the instructions for use of the products, or when the Customer uses the products for purposes other than those for which they are intended.
7. Privacy and Data Processing
7.1 HypeAndTrend.com respects the privacy of the Customer and processes personal data in accordance with the applicable legislation, including the General Data Protection Regulation (GDPR). For more information about how HypeAndTrend.com handles personal data, please refer to the privacy policy .
7.2 HypeAndTrend.com will never provide the Customer's personal data to third parties without permission, except when this is necessary for the execution of the agreement (for example in the event of payment and delivery).
8. Force Majeure
8.1 HypeAndTrend.com shall not be liable for any delay or damage resulting from force majeure, such as (but not limited to) war, natural disasters, strikes, disruptions in the delivery of goods or services, or other unforeseen circumstances beyond the control of HypeAndTrend.com.
9. Applicable Law and Disputes
9.1 These Terms and Conditions and the agreement between HypeAndTrend.com and the Customer are governed by Dutch law .
9.2 All disputes arising from the agreement or the use of the HypeAndTrend.com website will be settled by the competent court in the Netherlands, unless mandatory legal provisions prescribe otherwise.
9.3 If the Customer is a consumer, he or she may submit a dispute to a dispute committee or mediation body, if applicable.
